Jury Award Could Exceed $473,000.00 for West Pittston Man

Jury verdict for patient who fell from gurney in medical complex.

Attorney Matthew A. Cartwright represented Louis Tabone in a 4 day civil jury trial in Luzerne County, which resulted in an award of $350,000.00 and with the applicable interest, the total could exceed $473,000.00.

On July 17, 1995, Mr. Tabone sustained injuries as a result of a fall from a gurney while on the property of the Pittston Medical and Emergency Complex. A nurse in the complex failed to restrain Mr. Tabone; he passed out and fell to the floor sustaining a broken nose, chipped teeth and facial lacerations.

The defense claimed that Mr. Tabone had a long-standing history of passing out and failed to tell the medical staff. Mr. Tabone denied this allegation.
