Jury returns $400,000 Verdict to Lackawanna County Man
A Lackawanna County jury returned a verdict of $400,000.00 regarding a motor vehicle collision on Wednesday after a three day trial before the Honorable Trish Corbett. The case arose when a triaxle dump truck struck the plaintiff Robert Parry from behind while Mr. Parry was stopped on Keyser Avenue, Scranton. On August 9, 1999 Defendant driver Russell Whitman admitted the crash occurred after he took his eyes off the road and drove into the back of Mr. Parry's vehicle at between 10 and 15 mph. Whitman was employed by Tyler Transport at the time.
As a result of the impact, Mr. Parry sustained two herniated discs in his low back as well as corresponding nerve damage. This required him to undergo courses of spinal injections and rigorous physical therapy. The jury was presented the testimony of Dr. Robert O'Leary who is the Director of the Spine Center at Allied Services, and Mr. Parry's doctor. Dr. O'Leary stated that Mr. Parry can expect to suffer from these injuries for the rest of his life. Atty. Daniel Webster Munley, of the law firm of Munley, Munley & Cartwright, who represented the Parry's, said, "I am ecstatic for the Parrys as justice was clearly served in this case".
The defense attempted to counter the Parry's contentions with the testimony of Dr. Peter Feinstein. However, cross examination of Dr. Feinstein revealed that he earns $750,000.00 per year testifying in litigation cases.
