Attorney Settlement for a woman who was rear-ended in Luzerne County
In June of 2005, Ms. Munley was representing a woman who had been rear-ended in Luzerne County. The Defendant Harry Panetta who rear-ended our client was also insured by Allstate. Our client had suffered soft tissue injuries. The maximum limits of Allstate's liability coverage for the Defendant and the maximum possible recovery available to our client was $15,000.00 but Allstate had never offered our client any amount to settle the case. However, on the verge of trial Allstate offered the policy limits of $15,000.00. Ms. Munley argued to the Court that Allstate Insurance Company was in bad faith for not having offered the $15,000.00 limits much earlier on, which caused expenses to be incurred in the case. She argued to the Court that the offer of $15,000.00 was not acceptable for our client. Allstate ultimately offered $125,000.00 to settle the case which was accepted by our client.
