A Luzerne County jury on Thursday awarded a couple $158,000 for damages their
property sustained from a gasoline spill in Lehman Township. Martin and Louise
Montigney were awarded the damages from George Maculloch, the owner of the
station that caused the gasoline spill. Attorney Matthew Cartwright, who
represented the couple, said the suit stemmed from an underground tank spill
that spread a dangerous gasoline additive through the couple's property and
well. The jury awarded $46,000 for loss of property value and $112,500 for
inconvenience and annoyance from being forced to drink bottled water. Cartwright
said the plaintiffs also reached a separate settlement with other defendants,
including Sun Oil Co., prior to trial.
