Attorney Julia K. Munley Helps High School Senior Graduate

06/13/07- SCRANTON, PA - Attorney Julia K. Munley successfully argued on behalf of an Abington Heights High School senior, who was barred from her graduation due to a missed final exam. The young woman had notified her teachers that she would be absent from her final exams because she was attending a mandatory orientation at her future college, Indiana University of Pennsylvania, where she was required to undergo placement testing. She had arranged to take her high school final exams on the make up day set by her school. However, on the morning of her high school finals, Abington Heights Administration contacted her mother, and demanded she return from the University. She returned home, and was able to complete all of the remaining exams, except for her English final. As a result, Abington Heights principal informed the young woman that she would not be able to make up the test, would receive a zero for a grade in English, could not walk with her classmates at graduation and would need to attend summer school. She was informed that current school policy allows students to miss exams for medical reasons only. That is when she contacted Atty. Julia K. Munley. Ms. Munley petitioned the court to allow the woman to take a make up exam, and if she passed, allow her to graduate with her class. After hearing the arguments, the Hon. Robert A. Mazzoni granted the emergency preliminary junction. "I think they were using her as an example. We filed the petition to help the school district along to do the right thing," said Atty. Munley. Attorney Matthew A. Cartwright Secures $3 Million Verdict for Misdiagnosis Victim
Wilkes Barre, Pennsylvania - May 2007 - A Luzerne County jury awarded $3 million to a woman erroneously diagnosed and treated for cancer in 2000 and 2001. Atty. Matthew A. Cartwright, a partner in Munley, Munley and Cartwright, and Atty. Sam Sanguedolce represented the victim as she earned a major victory in this high-profile medical malpractice lawsuit.
The jury determined that two of the victim's physicians were responsible for the misdiagnosis and the errant treatment. The victim was awarded damages for the pain and suffering she endured by undergoing extended hospitalization and intensifying chemotherapy, which caused hair loss, nausea, episodes of coughing blood, painful sores throughout her mouth and throat and blood clots in her lungs that required surgery. She also battled anxiety, depression and fear about her mortality and leaving behind her two young children.
The doctors mishandled several tests that would have proved the victim never had cancer, including one negative test result that was inaccurately recorded as positive.
They "dropped the ball," Atty. Cartwright argued about his client's caregivers. "And they dropped it about a dozen different ways. What happened to [the victim] should not have happened"
The trial lasted three weeks and named Drs. Karen Cooper, of Forty Fort, and Gazi
Abdulhay, of Allentown, as defendants. The jury found the misdiagnosis was a direct result of the doctors' negligence. The Hon. Michael Toole presided over the case.

Attorney Daniel Webster Munley was among a number of specially invited dignitaries to attend the French government's unveiling of a commemorative plaque honoring French victims of the 9/11 attack on the World Trade Center. The ceremony, held at the French Consulate in New York City, was presided over by French Consulate General Richard Duqu? Mrs. Dening Lohez, widow of Jerome Robert Lohez, requested Attorney's Munley's presence at the French ceremony.

Mr. Lohez was a senior applications architect at NexxtHealth, a subsidiary of Empire Blue Cross and Blue Shield, located on the 26th Floor of the World Trade Center. He was also a veteran of the French Army's 53 Artillery regiment and had just returned from visiting his family in France when he was killed in the 9/11 attacks. Mr.. Lohez was set to release a software product for his company, which was thought to be a breakthrough in the industry, on September 11, 2001.

A volunteer in the American Trial Lawyers Association's (ATLA) Trial Lawyers Care Program established by ATLA for attorneys to provide free representation to victims of 9/11 tragedy. Attorney Munley stated "following the tragic event, many Americans were looking for ways to help. I felt this program was a way for me to take my abilities and apply them."

Through Attorney Munley's efforts in presenting the claims to the Victims Compensation Fund and with the assistance of life-long friend Brian Kelly, CPA, Mrs. Lohez, was awarded $3.9 million.

To express her gratitude, Mrs. Lohez invited Attorney Munley and Mr. Kelly, and their wives, Valerie Munley and Melissa Kelly, to attend the French Consulate Event. The plaque, will forever hang in the lobby of the French Consulate.
