Dangerous Childrens’ Toys

Dangerous Childrens' Toys

Our youngest consumers face some of the gravest risks of injury or death from defective products. Dangerous toys continue to find their way into children’s hands and into their mouths without adequate warning from manufacturers. Last year, an estimated 104,700 children were treated in U.S. hospital emergency rooms after toy-related incidents, including 13 children who died, according to the U.S. Consumer Product Safety Commission (CPSC).

If you believe your child was injured by a dangerous or defective toy, contact Munley, Munley & Cartwright, P.C., today online for a free consultation or call us toll free at 877-421-9173.

At Munley, Munley & Cartwright, our Pennsylvania product liability lawyers are familiar with product liability claims stemming from dangerous and defective toys, including two of the most common sources of toy-related injuries and death.

Lead Paint Contamination

Despite federal regulations that prohibit lead-based paint from being used in children’s toys, products continue to make their way into the market that are painted or coated with this dangerous material. For instance, in 2007, Mattel had to recall more than 600,000 Barbie accessory toys due to suspected lead contamination.

Young children, who are naturally inclined to put objects like cars, dolls and toy jewelry in their mouths, can be exposed when they eat lead paint chips or dust from paint chips, or when they lick their fingers after playing with a toy.

Lead poisoning in children has been associated with blood poisoning and brain damage that causes behavioral problems, learning disabilities and growth retardation. Death is also a very real possibility.

Small Magnetic Pieces and Parts

Small magnets, such as those found in building sets and other toys, can kill children if two or more are swallowed. According to the CPSC, there have been at least 33 cases of young children suffering injuries from ingesting magnets, including a 20-month old child who died and 19 other children between the ages of 10 months and 11 years old who needed surgery to remove swallowed magnets.

A serious danger is raised when a child swallows more than one magnet. These objects can attract to each other through intestinal walls, causing holes, twisting or blockage of the intestines and leading to infection, blood poisoning and death. If this occurs, surgery may be required to remove the magnets or small pieces of magnet.
